Welcome to CredMont, a decentralized data collective (DataDAO) operating on the Vana blockchain protocol. By accessing or using our website (credmont.cc), services, tools, or applications (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use our Services.

1. Introduction

CredMont enables users to contribute anonymized credit card transaction data, participate in decentralized governance, and earn rewards through our blockchain-based platform. These Terms govern your interaction with our Services and outline your rights and responsibilities as a user or member of the CredMont DataDAO.

2. Eligibility

  • You must be at least 18 years old and legally capable of entering into contracts in your jurisdiction to use our Services.
  • If you represent an entity, you confirm you have the authority to bind that entity to these Terms.

3. User Contributions

  • Data Ownership: By contributing data, you represent and warrant that the data is yours and you have the legal right to share it.
  • Anonymization: All contributed data is anonymized and encrypted using differential privacy techniques before processing or use.
  • License Grant: You retain ownership of your data but grant CredMont and its DataDAO a non-exclusive, worldwide, transferable license to use, aggregate, and process your anonymized data for purposes determined by DAO governance (e.g., AI model training, analytics, or data licensing).
  • Withdrawal: You may withdraw your data contributions at any time, subject to technical limitations of blockchain immutability, by following the process outlined in our Privacy Policy.

4. Rewards

  • Contributors may earn rewards (e.g., $VANA tokens or CredMont's future governance tokens) based on the volume, quality, and value of data contributed, as determined by DAO governance and token economics.
  • Rewards are not guaranteed and are subject to availability, governance decisions, and market conditions.

5. Collective Governance

  • CredMont operates as a DataDAO, where decisions regarding data usage, licensing, and monetization are made collectively through on-chain voting.
  • By participating, you agree to abide by the governance rules established by the CredMont community. You may participate in governance by holding governance tokens or delegating votes.

6. Usage Restrictions and Prohibited Conduct

You agree not to:

  • Use the Services for illegal, harmful, or fraudulent activities.
  • Attempt to breach or circumvent security measures, including unauthorized access to data or accounts.
  • Distribute malicious software or disrupt the Services.
  • Infringe upon the intellectual property or privacy rights of others.
  • Violate these Terms or any applicable laws, including GDPR and PCI DSS.

CredMont reserves the right to investigate misconduct and take appropriate actions, including suspending or terminating access, reporting to authorities, or pursuing legal remedies.

7. Data Security

  • Data is processed and stored using end-to-end encryption, differential privacy, and secure computation protocols via Vana and optionally Phala Network.
  • We comply with GDPR, PCI DSS, and industry best practices to protect your data.
  • No personally identifiable information (PII) is collected, stored, or shared.

8. Intellectual Property

  • All content on the Services, including text, logos, and software, is owned by CredMont or its licensors and protected by copyright and intellectual property laws.
  • You are granted a limited, non-exclusive license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

9. Limitation of Liability

  • CredMont provides the Services "as-is" without warranties of any kind, express or implied.
  • CredMont, its team, and affiliates will not be liable for indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to data loss, financial losses, or governance outcomes.
  • You are solely responsible for securing your blockchain credentials (e.g., private keys) and wallet addresses.

10. Dispute Resolution

  • Any disputes arising from these Terms or your use of the Services will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Wyoming, USA.
  • You waive any right to participate in class action lawsuits or class-wide arbitration against CredMont.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. You consent to the exclusive jurisdiction of Wyoming courts for any non-arbitrable claims.

12. Amendments

  • CredMont reserves the right to modify these Terms at any time. Changes will be effective upon posting on credmont.cc.
  • Continued use of the Services after changes constitutes acceptance of the updated Terms.

13. Termination

CredMont may terminate or suspend your access to the Services at its sole discretion, with or without notice, for violations of these Terms or other reasons.
